Welcome to MakrX Private Limited ("MakrX", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our digital manufacturing ecosystem including websites, applications, and related services (collectively, the "Service"). By using MakrX you agree to these Terms and our Privacy Policy.
2. Account Terms and Registration
2.1 Account Creation
- You must be at least 18 years old with capacity to enter into contracts.
- Provide accurate, complete, and current information during registration.
- Maintain the confidentiality of your credentials and notify us of unauthorized access.
- Accounts are non-transferable and intended for the registered individual or organization.
2.2 Account Types
Maker Account
Individual creators accessing makerspaces, events, and community resources.
Makerspace Owner
Organizations running makerspace facilities with MakrCave management tools.
Service Provider
Manufacturing partners offering fabrication, machining, or assembly services.
2.3 Account Suspension
We may suspend or terminate access for violations, fraudulent activity, or security risks. You remain responsible for fees incurred prior to termination.
3. Acceptable Use Policy
3.1 Permitted Uses
- Collaborate on maker projects and prototypes
- Book and manage equipment across participating makerspaces
- Purchase tools, components, and materials from MakrX Store
- Request custom manufacturing from verified service providers
- Access educational programs, certifications, and community events
3.2 Prohibited Activities
You must not use MakrX services to:
- Violate any applicable law or regulation
- Infringe intellectual property or proprietary rights
- Upload malicious code or compromise platform security
- Harass, threaten, or abuse other makers
- Manufacture prohibited or dangerous items
- Engage in fraudulent, deceptive, or misleading practices
4. Payment Terms and Billing
4.1 Subscription Services
MakrCave subscriptions are billed monthly or annually in advance. Fees are non-refundable unless required by law or stated in applicable service-specific policies.
4.2 Marketplace Transactions
- Payment is due at the time of order placement.
- Custom manufacturing requires a 25% advance payment.
- Remaining balances are charged when production completes.
- Taxes, duties, and shipping fees are calculated separately.
4.3 Refunds and Cancellations
- • Digital services: 7-day refund window for unused subscriptions.
- • Physical products: 14-day return policy for unopened items.
- • Custom manufacturing: Non-refundable once production begins.
- • Subscriptions: Cancel anytime; refunds prorated for unused periods.
5. Intellectual Property Rights
MakrX retains all rights in platform software, documentation, trademarks, and proprietary content. You may not reproduce or redistribute our intellectual property without written consent.
You retain ownership of user-generated designs and projects. By uploading content you grant MakrX a limited license to host, process, and deliver related services.
We honor valid takedown requests and may terminate accounts for repeated infringement.
6. Liability and Disclaimers
Service Disclaimer
MakrX services are provided on an "as is" basis without warranties of any kind. We do not guarantee uninterrupted or error-free operations.
Our maximum liability for claims arising from your use of the Service is limited to fees paid in the 12 months immediately preceding the claim.
MakrX is not responsible for the quality or legality of third-party services offered through the marketplace. Engage with providers at your discretion and risk.
7. Dispute Resolution
7.1 Governing Law
These Terms are governed by the laws of India. Exclusive jurisdiction rests with courts located in Bangalore, Karnataka.
7.2 Dispute Process
- Contact MakrX support for informal resolution.
- If unresolved, escalate to binding arbitration in Bangalore, India.
- Class action suits are waived in favor of individual arbitration.
8. Platform Security and Data Protection
We follow industry-standard security measures to safeguard data but cannot guarantee absolute security. Usage of the platform is at your own risk.
Personal data is processed in accordance with the Digital Personal Data Protection Act, 2023, and our Privacy Policy.
9. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email or platform announcements. Continued use after updates constitutes acceptance of the revised Terms.
